Personal Injury
The most common type of personal injury involves auto negligence. Because the at fault driver’s insurer or one’s own insurer (in the case of an underinsured or uninsured at fault driver) will be responsible for compensating an injured party for his or her injuries and damages, there exists an adversarial relationship which demands legal representation. My experience as a former insurance defense attorney and, subsequently, as a seasoned trial attorney representing injured persons has provided me not only a wealth of experience to draw upon in my representation of clients, but also a unique perspective of how insurance adjusters evaluate a case and what documents and/or damages are necessary to maximize one’s recovery.
Product Liability
In order to successfully prosecute a products liability case, an injured party must prove that the product was defective and the the defect made the product unreasonably dangerous. As a former insurance defense attorney, I represented many commercial entities which either manufactured a defective product or distributed a product which malfunctioned, causing an injury. This experience has been invaluable to my clients since moving to the Plaintiff’s side, as I have developed considerable insight about how to establish the evidentiary foundation to pursue a products liability action and know how and where to uncover crucial evidence and documents.
Premise Liability
Under a theory of premises liability, Florida law holds property owners liable for dangerous conditions encountered on their property by visitors who are injured as a result of those dangerous conditions. These dangerous conditions can vary from failing to prevent dangerous persons from accessing the property to allowing a foreign substance to accumulate on the property owner’s floor, making the floor slippery for unsuspecting patrons using the floor. The sooner an injured visitor secures counsel, the greater likelihood there is that the security video taken by the property owner, along with any photos and witness statements, will be preserved. Any delay in conducting a thorough investigation can cause considerable prejudice to an injured party’s efforts to prove his or her claim. I can offer not only my experience of handling many civil trials involving slip and fall and trip and fall cases on behalf of injured persons and business owners, but also my diligence in taking immediate action to preserve evidence.
